Property Conveyancing – Right to Final Inspection on your Property Transfer

 

Are you aware as a Property Purchaser you are entitled to complete a Final Inspection on the property you are purchasing prior to the property conveyancing and settlement being completed.

Under the Terms and Conditions contained in the Sales and Purchase Agreement under Possession and Settlement 3.2 (1)if the property being sold is with vacant possession you may enter the property on one ocassion  prior to the possession date for the purposes of examining the property, chattels, and fixtures which are included in the sale; and 3.2 (2) to re-enter the property on or before the possession date to confirm compliance by the vendor with any agreement made by the vendor to carry out any work on the property and the chattels and the fixtures.

The thing to remember is the property being transferred must be in the same condition as at the date of the Agreement for Sale and Purchase.

We would recommend you complete your Final Inspection at least 2 days prior to the Property Conveyancing of the settlement and possession date being completed.

You should be provided with a Final Inspection Waiver by your Conveyancing Practitioner which you should sign confirming the following:

1.  The property is in the same condition as at the date of the Agreement for Sale and Purchase.

2.  There are items which need to repaired and rectified.

3.  Or you are waiving your right to complete a Final Inspection on your Property Transfer.

We would recommend that you expand the general Terms and Conditions for the property with the following:

A warranty from the Vendor that the dwelling and property including the lawns, gardens and surrounds will be left neat and tidy at settlement.

The Pre-Settlement Inspection On Your

Property Transfer

Every Purchaser is entitled to complete a Pre-Settlement Inspection on the property they are purchasing prior to settlement.

This is generally completed 1 or 2 days prior to the settlement date and organised through your Real Estate Agent unless the property transfer is through a Private Treaty, then it would be arranged by your Conveyancing Practitioner directly with the party who is providing Conveyancing Services for the Vendors.

When you are completing your Pre-Settlement Inspection you are checking to make sure the Chattels listed in the Sales and Purchase Agreementare in the same state of repair as at the date the Agreement was signed.

This is detailed in Clause 6.2 (1). We would recommend a further warranty be included in the Agreement for the property transfer as per:

Example; The Vendors warrant at settlement all gas, electrical, plumbing fixtures and fittings will be in good working order.

Have you ever thought to take a hair dryer when completing your Pre-Settlement Inspection to check all the power points are working?

You could even prepare a check list of the chattels that are listed in the Agreement for your property transfer and tick them off as you are checking the working condition.

If you discover that something is not working you will need to let your Property Conveyancing Representative know so they can quickly get onto the Vendors Representative to get this sorted before settlement is completed.

Final Inspections

Good afternoon. Do you have the right to a final inspection prior to possession date? Yes. Condition 3.2 in the Agreement for Sale and Purchase clearly states; If the property is sold with vacant possession the vendor shall permit the purchaser or any person authorised by the purchaser in writing upon reasonable notice: (1) to enter the property on one occasion prior to the possession date for the  purposes of examining the property, chattels and fixtures which are included in the sale. Furthermore if the vendor has agreed prior to settlement and possession to repair or carry out any works you may re-enter the property to confirm compliance of the works.
