The Pre-Settlement Inspection On Your

Property Transfer

Every Purchaser is entitled to complete a Pre-Settlement Inspection on the property they are purchasing prior to settlement.

This is generally completed 1 or 2 days prior to the settlement date and organised through your Real Estate Agent unless the property transfer is through a Private Treaty, then it would be arranged by your Conveyancing Practitioner directly with the party who is providing Conveyancing Services for the Vendors.

When you are completing your Pre-Settlement Inspection you are checking to make sure the Chattels listed in the Sales and Purchase Agreementare in the same state of repair as at the date the Agreement was signed.

This is detailed in Clause 6.2 (1). We would recommend a further warranty be included in the Agreement for the property transfer as per:

Example; The Vendors warrant at settlement all gas, electrical, plumbing fixtures and fittings will be in good working order.

Have you ever thought to take a hair dryer when completing your Pre-Settlement Inspection to check all the power points are working?

You could even prepare a check list of the chattels that are listed in the Agreement for your property transfer and tick them off as you are checking the working condition.

If you discover that something is not working you will need to let your Property Conveyancing Representative know so they can quickly get onto the Vendors Representative to get this sorted before settlement is completed.

Contract Conditions

When dealing with an Investment is pays to get the correct advice! This is exceptionally important when it comes to dealing with your Property Conveyancing and Property Transfer.

More importantly the right advice is needed to make sure the Conditions in your Contract reflect and protect your interest.

Lets look at how a particular Condition can be worded as an example Building Report Condition:

Does the condition contain the 6 elements to ensure your property transfer is protected?

What needs to be done?

* Who’s going to do it?

* Who is going to pay for it?

* When does it need to be done by?

* What is going to happen if something is discovered?

* Who is going to pay to fix it?

If the Contract is conditional upon you obtaining a Building Report is it to be to your full satisfaction? Or do you want the condition to be worded so you have the ability to ask the owner of the property to rectify or provide you with a price reduction in lieu of getting things fixed.

The key is keep it simple. Have the condition for your Property Conveyancing worded in plain english so it can be easily determined. Better still engage the Conveyancing Services for your property transfer from a Registered Conveyancing Practitioner.

Rotorua Residents Information

FOR ROTORUA RESIDENTS

 

Effective from 1 December 2010 the Rotorua District Council passed a bylaw regarding the installation of approved wood or pellet burners which may affect the property you are selling/buying.  We suggest if the property you are buying/selling has a wood burner, you contact us for further information.  As from 1 May 2012 a property cannot be sold with a non-compliant solid fuel burner.

Hello all I read an interesting  in article in the Australian Institute of Conveyancers NSW newsletter the other day about cheap conveyancing and settlement fees.

The Profession of Conveyancing is not opposed to  competition on fees based on comparable services. The choice of a Conveyancer based on the fees has a corrupting influence in the market place.

Those that offer low fees in a Professional and Legal environment to win clients is stepping into dangerous territory. In most cases such Firms are cutting corners without the client knowing and putting the client at risk especially when a transaction goes pear shape, and this also has an impact on the other party acting on the other side of the dealing.

Service delivery to the client is greatly compromised. When someone is willing to pay peanuts you can guarantee they will be dealing with monkeys, and in the end will always wish they had engaged with a Professional.

The transaction should not be about the cheapest fee, but based on integrity, trust and honor. In consideration of the value of the dealing being settled.
